Some collision cases, like 18 wheeler accidents, can involve legal issues unique to them. You may have heard the old expression “Don’t make a federal case out of it.” It means don’t make a big deal out of it. Do you think insurance companies want your lawyer to make a big deal out of your car or other vehicle accident case? Probably not. Why? It’s obvious- so they can pay you less.
For the last 15 years Flick Law Firm has been “making a federal case out of it”. Federal court is limited to larger cases involving citizens of different states or cases involving a question of federal law, so many personal injury cases don’t qualify to be filed there.
Federal court procedures can be more complex and technically demanding than in state court. It’s not easier. In fact, it’s more work and requires additional knowledge and skill. Not surprisingly, personal injury lawyers often prefer to avoid federal court.

Sounds kind of boring doesn’t it? But it can be really important to your case.
Courts rely heavily on prior court decisions, statutes (laws) and procedure rules to determine how your case proceeds. In federal court this is especially important. These rules may change as new decisions are made, laws passed and procedure rules modified. Further, small changes in facts can significantly change the rules applicable to your case. You can easily see how essential researching these decisions, statutes and rules can be to the result you want.
Historically, lawyers did legal research in law libraries full of volumes of past court decisions and statutes. Some still do. The work can be painstaking and slow. To do higher quality research, more efficiently we acquired the capability for online research of federal and all 50 states court decisions and statues. This program also provides 24/7 research assistance by US based lawyers. Tremendous improvement in our legal research capability and efficiency has resulted.
Document Management
Another exciting subject, right? Not so much, but it can be really important to success in your case.
Lawsuits can create paper storms of thousands and even millions of documents. Historically, lawyers organized them with a system of expanding file pockets and boxes. This system can be overwhelmed in big cases resulting in lost or misfiled documents.
More than ten years ago we identified this issue and sought solutions. Being unable to find software that fit our requirements, we built our own electronic file system. Our system can input paper documents, e-mails and data files, search for words and phrases, copy text or pictures, print and email documents. Files can be transferred from desktops to laptops for courtroom use. And these are just part of its capabilities.
We also have other cool technology. We know that insurance companies and probably their defense lawyers look at this site. Do you want us to tell them about all the tools we have to deal with their tactics and systems? Maybe not. So we don’t want to say too much. Lawrence Flick, our Senior Attorney and Litigation Director, graduated from the University Of Kansas School Of Law in 1982 and received his Juris Doctor (J.D.) degree. That year he was admitted to practice before Kansas state and federal courts. Lawrence is a member of the Missouri Bar and is also admitted to practice before United States District Courts for the Western District of Missouri, District of Colorado and the U.S. Courts of Appeals for the 8th and 10th Circuits.
